ASHAVI provides the online Q&A for multi-purpose usage. ASHAVI owns and control and ASHAVI services, and provides access to the www.ashavi.com website, and all sub-domain relating to it, software, data and materials via the website.
We follow the Vietnamese Law.
All the conflicts would be solve with the constructive discussion between ASHAVI and all parties. In case they couldn't be solved in peace, we should proceed to Ho Chi Minh Court, Vietnam.
PERSONAL DATA SECURITY AND LAWFUL PROCESSING
1.1. ASHAVI will store and process your Content in a manner consistent with industry security standards. ASHAVI has implemented appropriate technical, organizational, and administrative systems, policies, and procedures designed to help ensure the security, integrity, and confidentiality of your Content and to mitigate the risk of unauthorized access to or use of your Content.
ASHAVI will treat your Content as confidential information and only use and disclose it in accordance with these Terms (including the ASHAVI privacy notices). However, your Content is not regarded as confidential information if such Content: (a) is or becomes public (other than through breach of these Terms by ASHAVI); (b) was lawfully known to ASHAVI before receiving it from you; (c) is received by ASHAVI from a third party without knowledge of breach of any obligation owed to you; (d) is shared in the context of your account being migrated to an organization’s Enterprise account, if your account is registered using a work email address within that organization; or (e) was independently developed by ASHAVI without reference to your Content. ASHAVI may disclose your Content when required by law or legal process, but only after ASHAVI, if permitted by law, uses commercially reasonable efforts to notify you to give you the opportunity to challenge the requirement to disclose.
If ASHAVI becomes aware of any unauthorized or unlawful access to, or acquisition, alteration, use, disclosure, or destruction of, personal data related to your account (“Security Incident”), ASHAVI will take reasonable steps to notify you without undue delay, but in any event within 72 hours of becoming aware of the Security Incident. ASHAVI will also reasonably cooperate with you with respect to any investigations relating to a Security Incident with preparing any required notices, and provide any other information reasonably requested by you in relation to any Security Incident, where such information is not already available to you in your account or online through updates provided by ASHAVI
1.2. Customer agrees that it will not, and will not permit its personnel or any third party to grant access to the ASHAVI SaaS or any component thereof to any person in excess of Client account.
1.3. Definitions: Data which are collecting from our platform would be:
a. Client account data which is input by Client.
b. Response data which is input by consumer.
c. Content of survey which is input by Client.
Content means any and all content or data (including but not limited to pictures, logos, survey questions, survey information, survey content, and all other kind of content) that Client and consumer submit to the SaaS platform of ASHAVI.
1.4. ASHAVI is responsibility to maintain confidentially data submit from all parties into our platform at our virtual server. We commit not to disclose to any other parties in any format, or form, even verbal, written.
We do not sell your personal data to any third party whatsoever.
1.5. Client will have access to response data, and the responsible to keep confidentially of response data is belong to Client. ASHAVI won’t take any responsibility if the response data has been revealed to other parties under Client’s decision.
1.6. ACCOUNT DELETION:
As mentioned in the term 1.10, your account remain live forever, till the time you request ASHAVI to delete your account by official email via research@ashavi.com or contact us via Chat tool.
After your request is confirmed, we will delete your account and all data relating to your account would be permanently deleted in our virtual server. After deletion, you will be never able to recover again the account and its data.
When you decide to ask us to delete your account, all the left balance amount in your account would be deleted as well without refundable condition.
In case you cause any fault and we have roof for all the fault, your account is also been deleted without any prior notification.
For other cases relating "force majeure" shall mean acts or events beyond the control of the ASHAVI including, but not limited to, acts of God, strikes, lockouts, or other industrial disturbances, riots, epidemics, landslides, floods, fires, washouts, arrests and restraints, civil disturbances, explosions, breakage of or accidents to pipe lines, bankruptcy, failure of equipment or, compliance with acts, orders, regulations or requests of any federal, state or local governmental authority, whether or not of the same class or kind, reasonably beyond the control of ASHAVI by exercise of due diligence, ASHAVI is unable to overcome. ASHAVI reserves the right to terminate this Agreement at any time with notice period 30 days.
1.7. INTELLECTUAL PROPERTY RIGHTS
All content posted on ASHAVI platform is must comply with Vietnam and International copy right law. Your content which is posted by you to our platform will be under your responsibility. We do not pre-screen your content and do not take any responsibility for your content. In case there is conflict or issue happen due to the customer's content, ASHAVI will remove the content in our platform with prior 1 day notice to the Customer.
1.8. LEGAL
ASHAVI apply and follow the Vietnamese law.
All the conflicts occur should be solved under Vietnamese law.
